These Terms of Service (“Terms”) govern your use of the Off The Couch Games website at offthecouchgames.com and your participation in experiences provided by Off The Couch Games LLC (“we,” “us,” or “our”) located at 555 Mowry Ave, Fremont, California 94536. These Terms also apply to our text message program. By accessing our website, booking or participating in an experience, or enrolling in our text message program, you agree to be bound by these Terms.

1. Bookings & Payment

All sessions are private and must be booked in advance through our authorized booking platform. Pricing is charge-by-time, billed per person per hour as displayed on our Pricing page. A deposit is required to secure your reservation, and bookings are confirmed when payment or deposit is received, subject to availability. Please arrive at least 15 minutes before your scheduled start time to check in and complete waivers; late arrivals may have a shortened experience. The remaining balance is calculated based on actual time played and collected at the conclusion of your session. All prices are in U.S. dollars and are subject to applicable taxes.

2. Cancellations & Rescheduling

All sales are final and non-refundable. You may reschedule your booking without penalty up to 48 hours before your scheduled session. Rescheduling requests made within 48 hours of the booking time may incur a rescheduling fee or may not be accommodated, depending on availability and circumstances. We are not responsible for no-shows. Please contact us as early as possible if your plans change.

3. Text Message (SMS) Program Terms

By providing your mobile phone number and agreeing to receive text messages from Off The Couch Games, you consent to receive messages related to your bookings and, if you separately opt in, promotional messages.

Program description. We send booking confirmations, reminders, waiver requests, payment receipts, customer service replies, and, with separate consent, occasional promotional offers.
How to opt in. You may opt in by checking the consent box next to the phone number field on our online booking form, by checking the consent box when signing our digital waiver, or by providing your number and consent to our staff. Promotional messages require a separate opt-in and are never sent based on a booking alone.
Cost. There is no charge from us for these messages. Message and data rates may apply from your mobile carrier.
Message frequency. Message frequency varies based on your bookings and activity.
How to opt out. Reply STOP to any message to stop receiving texts from us. You will receive one confirmation message and no further messages after that. You may also contact us directly to be removed.
Help. Reply HELP to any message for assistance, or contact us at contact@offthecouchgames.com.
Not a condition of purchase. Consent to receive text messages is not required to book with us or to purchase anything.
Carriers. Wireless carriers are not liable for delayed or undelivered messages.
Privacy. Mobile information and text messaging consent are never shared with or sold to third parties or affiliates for marketing purposes. See our Privacy Policy.

4. Conduct & Eligibility

All guests must be sober during the experience. Groups arriving intoxicated may be denied participation without refund.
Some experiences contain low lighting, theatrical effects, and intense thematic content. They are not suitable for young children. Minimum recommended age is 16 unless accompanied by a participating adult.
Guests must not damage, tamper with, or remove any props, fixtures, or equipment. Any damage caused by a participant will be the financial responsibility of the booking party.
Photography and video recording inside the experience rooms are strictly prohibited to protect the integrity of the story and puzzles for future guests.
We reserve the right to terminate a session early for safety reasons, violations of these Terms, or behavior that endangers guests, staff, or property. No refund will be issued in such cases.

5. Photos

We may take photos at the end of an experience. You may decline, and you control whether photos are shared with you or used publicly.

6. Participant Waiver

All participants are required to complete our Participant Waiver before entering an experience. A waiver link is sent in your booking confirmation email, and waivers can also be completed in person when you arrive. Participation will not be permitted without a completed waiver on file.

7. Intellectual Property

All content on this website and within our experiences — including but not limited to room designs, puzzles, storylines, characters, artwork, branding, and sound design — is the exclusive intellectual property of Off The Couch Games LLC and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, record, distribute, or publicly share any portion of our experiences or website content without our prior written permission.

8. Disclaimer Of Warranties

Our website and services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation Of Liability

To the fullest extent permitted by applicable California law, Off The Couch Games LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or participation in our experiences, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount paid by you for the session giving rise to such claim.

10. Indemnification

You agree to indemnify and hold harmless Off The Couch Games LLC, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your violation of these Terms or your conduct during an experience.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the courts of Alameda County, California.

12. Changes To These Terms

We may update these Terms from time to time. The “last updated” date at the top of this page reflects the most recent revision. Continued use of our website or services after any changes constitutes your acceptance of the revised Terms.
